Additional design changes outside the agreed scope may incur extra fees.

6. Shopify and E-Commerce Services

For Shopify and e-commerce development services:

Shopify subscriptions and third-party application fees are the client’s responsibility unless agreed otherwise.
Payment gateway approval and merchant account verification are subject to the respective providers.
Clients are responsible for product information, pricing, inventory, shipping, and order fulfilment.
We do not guarantee sales, revenue, or profits from an online store.
Shopify platform features and policies may change independently of our services.

7. SEO Services

SEO is a long-term digital marketing process.

Sky King Digital Services may provide keyword research, on-page optimization, technical SEO, content recommendations, and other SEO-related services.

However:

We do not guarantee specific Google rankings.
Search engine algorithms and ranking factors may change without notice.
Results depend on competition, website quality, industry, and other factors.

8. Google Ads and Meta Ads Services

For advertising campaign management:

Advertising budgets are generally paid directly by the client to the relevant advertising platform.
Campaign performance depends on budget, competition, targeting, landing pages, and market conditions.
We do not guarantee leads, sales, clicks, conversions, or return on advertising spend.
Advertising accounts must comply with Google, Meta, and other applicable platform policies.
Account suspensions, disapprovals, and policy decisions are controlled by the respective platforms.
Clients are responsible for the accuracy and legality of their advertisements, products, and business claims.

9. Client Responsibilities

Clients agree to:

Provide correct and complete project information.
Supply legally authorized content, images, and branding materials.
Make payments according to agreed terms.
Respond to project queries and approval requests within a reasonable time.
Avoid requesting unlawful, deceptive, or prohibited activities.
Maintain the security of their website and account credentials.
Ensure that their products and services comply with applicable laws.

10. Intellectual Property Rights

All original designs, website layouts, graphics, content, and other materials created by Sky King Digital Services remain our property until the agreed payment has been received in full, unless otherwise agreed in writing.

Upon full payment, ownership or usage rights for specifically agreed deliverables will transfer to the client, subject to third-party software licenses, stock assets, themes, plugins, and other applicable restrictions.

Sky King Digital Services retains ownership of its business name, logo, branding, proprietary tools, and pre-existing materials.

11. Revisions and Modifications

The number of revisions included in a project will depend on the agreed service package or project proposal.

Requests beyond the included revisions or changes to previously approved work may be charged separately.

We will communicate additional charges before proceeding with such work.

12. Website Maintenance and Support

Website maintenance and technical support are provided according to the selected package or separate agreement.

Unless specifically included, ongoing hosting, domain renewal, software subscriptions, security monitoring, backups, and maintenance are not automatically included in website development charges.

13. Third-Party Services

Our services may involve third-party platforms and providers, including:

Domain and hosting providers
Payment gateways

We are not responsible for independent changes, service interruptions, account restrictions, pricing changes, or technical failures caused by third-party providers.

14. Limitation of Liability

Indirect or consequential business losses.
Loss of revenue, profits, or expected sales.
Search engine ranking fluctuations.
Advertising platform restrictions or suspensions.

Unauthorized access resulting from compromised client credentials or external security incidents beyond our reasonable control.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

15. Confidentiality

We respect the confidentiality of client business information, project details, login credentials, and other information shared during service delivery.

We take reasonable steps to prevent unauthorized disclosure and use confidential information only for legitimate business purposes or as otherwise permitted by law.

16. Cancellation and Refunds

Work already completed, third-party expenses, non-refundable subscriptions, and other committed project costs may be taken into account when determining any eligible refund, subject to applicable law.
